"Those who are concerned about preventing death and illness meet in public... The
merchants of addiction, however, meet in secret and conspire to confuse the public.
As Judge Sarokin, who presided at the Cipollone trial last spring, put it in
describing the cigarette industry, '...the industry ...entered into a sophisticated
conspiracy ...to confuse and mislead the consuming public in an effort to
encourage existing smokers to continue and new persons to commence smoking.'" "...the
jury was not asked to decide whether there was a conspiracy after 1965 because the
federal courts have held that the federal cigarette warning labels immunize the
tobacco companies from tort liability after 1965." [click on image to enlarge

"This strategy of trying to create doubt and confusion about the dangers
of smoking appears to be continuing. In a hearing last June before our
subcommittee, the President of Liggett, Mr. Dey, testified that it was his
opinion, and the position of Liggett, that 'it has not been established cigarette
smoking causes lung cancer or any other disease in humans.' ...The President
of Liggett said that the 'profits levels for branded cigarettes are higher
than for any other consumer product of which I am aware.'"

"There are several ways to respond to these threats, and all must be used. In
basketball jargon, we should use a 'full-court' press against the merchants of
addiction. One pressure point is to continue urging Congress to restrict the
places where smoking can occur."
